HIPAA Compliance

eTranslation Services is HIPAA-Compliant

As a language services provider for medical facilities and institutions, eTranslation Services is their business associate. As such, eTranslation Services complies with the regulations of the Health Insurance Portability and Accountability Act of 1996 (HIPAA), which requires all hospitals, clinics, nursing homes, care facilities, hospices, and other healthcare institutions to comply with the mandate to protect the privacy and personal information of all patients.

Aside from the healthcare facilities, HIPAA also requires their business associates, such as lawyers, insurance companies, medical billing services, and language services providers to be HIPAA-compliant as well.

This means we have to ensure that the security and confidentiality of Protected Health Information (PHI) included in the medical translations we do.

HIPAA Compliance

eTranslation Services complies with the HIPAA regulations, and we enforce them in our company in the following manner:

  • eTranslation Services will use protected health information (PHI) solely for translation or transcription purposes, as specified in the business associate contract we have with covered entities.
  • As required by law, eTranslation Services will not use or disclose the PHI included in the translation projects we accept.
  • eTranslation Services ensures clients that we will use all applicable safeguards to prevent unauthorized use or disclosure of protected health information, by accident, or with reasonable cause.
  • We have installed the essential administrative, technical, and physical safeguards to ensure the integrity, confidentiality, and privacy of all electronic PHI transmitted to us.
  • eTranslation Services has the necessary procedures to implement corrective action if there is any accidental or reasonable cause of violating the privacy requirement of HIPAA.
  • According to our client agreement, eTranslation Services will immediately report any occurrence of PHI disclosure to clients, as soon as it comes to our knowledge.
  • Following 45 CFR 164.528, eTranslation Services agrees to make all internal records and practices, including procedures and policies concerning PHI use and disclosure, available to clients within seven days after receipt of the request.

Administrative Safeguards – 45 CFR § 164.308

eTranslation Services has enforced administrative safeguards by appropriately assigning limited access permissions to electronic protected health information. We see to it that all our staff members receive information security awareness training. We also make sure that we have prepared the contracts between eTranslation Services and the covered entities we serve.

Physical Safeguards – 45 CFR § 164.310

eTranslation Services ensure that our physical office and data centers are secure. Entry to our offices is controlled by card access to prevent unauthorized entries day and night. We see to it that we have the appropriate safeguards to protect our office locations from theft, flood, fire, and other preventable or foreseeable disasters.

Technical Safeguards – 45 CFR § 164.312

eTranslation Services ensure the integrity and security of our software, hardware, and data storage device to safeguard electronic protected health information. We use Secure Socket Layer (SSL) technology to protect PHI sent over the internet. We implement policies and procedures, such as encryption, entity authentication, automatic logoff, and emergency access procedures.

Website User Agreement

These Terms and Conditions are a legally binding agreement between the User (You) and eTranslation Services (We, Us, Our, Ours). The agreement defines the stipulations:

  1. The way the User is allowed to request a quote using our online form and use our website to place an order for our products, services, and solutions.
  2. The way we use the information you gave us voluntarily so we can respond to your request to provide you with our products, services, and solutions, and to make any revision to your order. Please read our Privacy Policy to learn how we treat the personal information you give us.
  3. The way we provide language services to all our clients, including translations, transcriptions, voice-overs and interpreting services.

eTranslation Services owns this website. It is protected by international trademark and copyright laws. 

You are not allowed to modify, reproduce, copy, download, upload, republish, or transmit any material from our website for your non-commercial and personal use without our express approval. 

Liability Limitations

eTranslation Services will not be liable under any circumstances for any damage or losses from the reliance or use of the materials displayed on the website. eTranslation Services will not be responsible for any loss that may arise or any special, consequential, incidental, or indirect damages, even if we are advised that such a possibility may occur.

eTranslation Services include all its employees, principals, partners, representatives and agents, and any third-party providers. We take all the necessary measures to safeguard each submitted file, source materials, and documents. However, eTranslation Services shall not be held accountable for document losses in case of natural disasters, computer viruses, power outage, software/hardware failure, or other unforeseen incidences that are beyond the control of the company.

The client (You) is responsible for saving a copy or back up of your files. eTranslation Services is in no way responsible to any of our clients and third parties for any document alteration, corruption, or loss.

Based on the definition of our services, eTranslation Services is only accountable for translating documents and other written materials. The thoughts, ideas, and views expressed in the documents are owned by the writers and clients using our services. The same terms apply when we provide transcription and voice-over services.

These Terms and Conditions are subject to the laws of the United States. Any dispute is under the sole jurisdiction of the courts in New Jersey.

Business Transactions

The User will submit a translation request using the eTranslation Services request form, which includes all the relevant details and the document or information relative to the request for translation or interpreting services.

eTranslation Services will send a quote based on the information the client provides. Upon approval, the User processes the payment required by eTranslation Services before the work on the translation, transcription, voice-overs, or interpretation commences.

General Provisions

  1. The User warrants that all information he/she provides is accurate, up to date, and correct. If your email address is not working and cannot receive emails, we are not responsible for the non-delivery of your translation and other language-related projects. We will try to contact you through your phone number to ensure that you can provide us with an alternative means to transmit your files.
  2. The User will process the payment for translation or interpreting requests before its commencement. Incomplete or delayed payment will affect the delivery of the translation project.
  3. In such an instance, the User is the sole party responsible for the delay.

Replacement and Cancellation

Our policies for replacement and cancellation of translation, transcription or voice-over projects are simple.

We see to it that all the services we offer to all our clients pass through our quality assurance process. If you are not fully satisfied with the quality of the output, please send us an email requesting a rework seven (7) days after receipt of the file.

Your email should provide us with the details regarding your concerns, disputes, and questions regarding the submitted work. If the translation falls short of eTranslation Services’ promise, we will redo the translation without additional charge. We need your written request so that our translators can respond to, address, or correct any editorial omission or mistake immediately. The request for rework only covers the original content, and we will redo the translation according to your initial instructions.

The client acknowledges and concurs with the company’s Refund Policy. Our policy on refunds clearly expresses that we offer our services to the best of our abilities. We start the project as soon as we receive payment for the requested service, and we guarantee the work that we do on behalf of the client. Again, please review our refund policy.

File delivery

We commit to deliver your translation, transcription or voice-over projects within the deadline we have set. In case you did not receive the document or file, please inform us immediately. Be sure to whitelist eTranslation Services so you can receive our email in your inbox. Likewise, please check your junk folder to see if the email from us is there.

Intellectual Property Rights

eTranslation Services and its translators do not make any claims on any piece of work sent to us for translation, transcription or voice-over purposes. All the documents coming from our clients remain their intellectual property. We ensure that our translators sign a confidentiality agreement, waiving their claim to the material.

Likewise, you have to assure us that you have the copyrights to the documents or portions of the content that belong to other parties. You also agree not to use our services for translating any material content that infringes, threatens, harasses, defames or abuses people and organizations politically, religiously, racially, ethnically, or otherwise. It also includes, without limitations, materials that can negatively affect the reputation, goodwill, and public image of eTranslation Services.

eTranslation Services reserves the right to amend or modify these Terms and Conditions at any time without prior notice. We advise you to check the site periodically to ensure that you are up to date with our terms.

The privacy of our customers is a priority for us here at eTranslation Services. We believe that our customers should be able to choose the information they want to provide to us and decide what happens to the information they share. Our Privacy Policy defines what information we require from you and how we treat the information when we provide you with language services. We reserve the right to change this Privacy Policy without notice from time to time, so we encourage you to check this page regularly.

The information we collect

When you order language service from eTranslation Services, we will ask you to provide us with some personal data like your complete name, phone number, email, physical address, zip code, and domain name (if applicable), which can identify you. eTranslation Services will also request you to provide financial details such as your credit card or bank account number.

Third-party websites and advertisers that have links to eTranslation Services.com may collect personal information. We wish to remind you that our Privacy Policy applies only to our website. Please read the privacy policy of other sites that you want to visit. 

Request for information

As a customer, you can request information concerning any of our language products and services, by filling up our online form, giving us a call at (800) 882-6058, or sending us an email at [email protected]. We will ask for your personal information as well so that we can send the information you request from eTranslation Services.  

Security

We assure you that when you order a language product or service online from us, your information will remain secure. Our Secure Sockets Layer (SSL) protocol protects our ordering process. Our system encrypts your data and verifies our server’s identity before it completes any transaction. We encourage you to update your browser to ensure your online protection.

Disclosure of information

eTranslation Services assures all our clients that we do not sell, share, disclose, trade, or rent out any client information to any third party. We limit the staff who will have access to your personally identifiable information. We also guarantee that we only use your personal information to bill you for the services we render or send you the requested information. We will only disclose your personal information if required by law. 

Use of your personal information

If you subscribe to our mailing list, we will be sending you announcements, promotional emails, and relevant information periodically. You can unsubscribe from our mailing list at any time. Moreover, we will use your email address if we encounter problems with your language services project or we have issues with website maintenance.  

We want to cater to the needs of all our clients, so we continue to upgrade our services. We do this by analyzing the demographics and personal information of our customers. The study we do will help us to administer our website better. The data we gather from our analysis will become helpful in coming up with plans to provide better products and services. We get valuable information regarding product purchase and usage and existing and potential target markets.

Please read our mailing policy and contact us if you have any questions. Our staff is available Monday through Friday, 9 am – 6 pm EST.

Need Your Documents Mailed?

We’ll send all copies electronically, but if you need the hard copies as well, we can mail within one day. DUE TO COVID RESTRICTIONS AND PER THE USPS MAILING TIMES HAVE BEEN EXTENDED:

  • US Express Mailing (1 – 3 days) $40.00 USD
  • US Standard Mailing (2-8 days) $25.00 USD
  • Canada mailing (8-12 days) $50.00 USD
  • International Mailing (10 -15 days) $75.00 USD

 

**Our mailing department is located in California. Due to the Covid-19 restrictions mailings are only being done on Fridays. If Friday is a Holiday the mailing will be done the following week. For different mailing needs, please contact us.

We provide a tracking number after we post the document to you.

eTranslation Services shall not be responsible for any modifications or edits made on the translated document after being approved by the client.

Refund Policy

This Refund Policy covers all the services that eTranslation Services offer.

CANCELLATIONS

Translation

We engage a translator as soon as we confirm your order. If you need to cancel your order, you should notify us immediately. You will receive a 100% refund if we have not yet assigned your project. We cannot give you a refund when we have already engaged a translator. Please understand that in most cases, we assign the project as soon as we receive an order.

Partial Cancellation

We accept partial cancellation for some services that you do not require, subject to the following conditions:

  1. The request is not yet executed, such as creating hard copies when you only need e-versions. We will refund the amount paid for the hard copies, as long as we have not sent the translation.
  2. We receive the cancellation request through email at [email protected], by calling (800) 882-6058 or chatting with us online.
 

Interpretation

Please be advised that our cancellation policies are: If you cancel within 3 days of the project, you will be charged a 50% cancellation fee. If you cancel within 24 hours of the scheduled job we will charge a 100% cancellation fee.

Edits

We accept edit requests on the spelling of names, word preferences or synonyms that were not given when you place the translation order, and if the scan shows unclear words. eTranslation Services will do the edits right away. You can request edits of the translations done by us as many times as needed. However, we do not do a cashback or refund for edit requests.

Mistranslations or errors

We see to it that our translations are consistently accurate. We have a quality control process to ensure that all our translations are of high quality, error-free and mistranslation-free. If you find a mistranslation or error in your translated document, notify us immediately so we can correct the mistake.

Provisions:

  • We would not issue a refund if you did not provide the word preferences and name spellings earlier.
  • You can reject the translation and request a refund if the mistranslation or error is due to our oversight and failure to meet our quality standards.
  • We would issue a refund if the mistake was due to our failure to proofread the translated document properly. The refund amount will depend on the extent of the compromised quality. We do not have any indemnity obligations or other liabilities other than correcting the errors or issuing a refund.
 

Missing pages

With our tight quality control process, we assure you that we do not leave out anything. But if you receive your translation with a section or page missing, notify us immediately by phone, email or online chat. We will quickly fix the omission. You can reject the translation of the missing section or page, or request a partial refund corresponding to the missing parts.

Formatting

If you have not provided us with a clear scan of the source document or you did not pay for desktop publishing (DTP), we cannot assure you that the translation format will be a 100% mirror image of the original. If this issue arises, we cannot give you a refund. We can only provide you with plain text translation if the scanned image is blurred.

Interpreting terms

We work with professional interpreters, but please keep in mind that they can only provide a verbal interpretation of what the speaker says. They are objective and will not give their opinion or further explanation while doing their job. If the context is needed, it will only be for choosing the proper terms to use.

Delay in delivery

We want to ensure that our translations are accurate, so each translation project passes through our strict workflow and quality assurance processes. Our delivery times are clearly stated in each quote and are based on 2,500 words per day, subject to the following conditions:

  • The word count is 2,500 or less
  • The target language is widely spoken (not obscure or rare language/dialect)
  • Text is not technical
  • No special formatting required

It will take 1 day or less to translate a document with a word count of 2,500 or less following our QA process.

You can only request a refund for a delay in delivery if we miss our quoted finish time.

  • Delay is less than 12 hours from the agreed time – 10% refund
  • Delays of more than 24 hours from the agreed time of submission – 15% refund
  • For projects of more than 5,000 words – subject to discussion on a case by case basis.
